dc.description.abstract | Предмет рада су етички аспекти деловања Међународног кривичног трибунала за бившу Југославију („Хашки трибунал“). Своја разматрања ауторка започиње увидом да су напори човечанства да хуманизује рат као per definitionem убилачку људску делатност стари готово два века. Њихов смисао је био да се смање непотребна и војно нецелисходна страдања превасходно цивилног становништва, забрани нечовечно поступање према заробљеницима, обуздају прекомерна разарања материјалних добара, речју, дефинише одређена, макар и минималистички конципирана, етика ратовања, која би начелима човечности ограничила разорне потенцијале овог, најдеструктивнијег међу свим облицима међуљудског одношења. Трећи у релативно кратком низу институционализованих напора човечанства у том правцу представља МКТБЈ. У централном делу рада ауторка указује на неке карактеристике деловања овог института међународне правде који озбиљно доводе у сумњу декларисану међународно-моралну мотивацију његових оснивача и финансијера. Анализом неколико случајева пред њим оптужених појединаца, чији елеменати добро илуструју тај увид, она закључује да Трибунал неће значајније допринети афирмацији идеје међународне правде, већ ће пре учврстити уверење у њену релативност, односно сумбисивност интересима моћних који су се у једном историјском тренутку преклопили са интересима неких од бројних актера једног комплексног балканског државно-територијалног разграничења. | sr |
dc.description.abstract | The efforts of humanity to humanize war as a per definitionem murderous human activity have been almost two centuries old. Such efforts were aimed at reducing the gratuitous and from a military angle absurd suffering of the prevailingly civilian population, banning inhuman treatment of captives, curbing extensive devastation of material assets – in othder words, defining warfare ethics albeit it may be minimalistically conceived, so as to limit the devastating potentials of the most destructive of all forms of human relations by applying some humane principles. The ICTY was the third in the comparatively short line of institutionalized efforts of humankind in that direction. The jurisdiction in rem of the ICTY relates to the serious infringements of the Geneva Conventions of 1949 on the protection of victims of war, breaches of laws and customs of war, genocide and crimes against humanity. Its jurisdiction was not limited by time as, at the moment of the foundation of the Tribunal, conflicts in former Yugoslavia were still under way. The court was formed with a declarative intent of delivering to the international public something different to the justice of the winner (Phil Clark) or of contributing with its decisions to the respect of human rights, peace and international justice, or, according to Bruce Cronin, of being an institution directed towards the common good, both of regional participants in the ex-Yugoslav conflict and the international community as a whole.The central part of the text is devoted to some characteristics of the activities of this institution of international justice which cast serious doubt on the declared international moral motivation of its founders and financiers. As such Tribunal is not going to make a significant contribution to the affirmation of the idea of international justice, but is rather going to strengthen belief in its relativity or subjugation to the interests of the powerful, which, at one moment, coincided with the interests of some of the numerous participants in a complex Balkan process of demarcation of territories and state borders. | en |
