AB  - Speaking of the institution of the police in his famous 1921 text “Zur Kritik
der Gewalt” (“Toward the Critique of Violence”), Walter Benjamin gives two
very important characteristics of police violence.1 The first and fundamental
characteristic is that the police are always connected to violence but that the
police’s role within the state is difficult to pinpoint, given that the police
constitute an “institution of the modern State” (Benjamin 1986: 286–87).
Our intention in this text is to show that police violence is a consequence of
a deformation of the institution of police or a deformation of violence.

AB  - In this paper we consider the correlation and interdependence between empathy and engaged acts,
i.e., acts undertaken in interacting with the other or others, through which the first-person singular
shifts to the first-person plural. We argue that engaged acts are a constitutive element of empathy. To
support our thesis, we address some issues with the common notion of empathy, specifically, those
related to the first-person and third-person accounts. Further, we discuss their alternatives in
phenomenology and interaction theories. In particular, we address two important aspects of empathy:
that of the second person perspective, and the issue of the Self/Other differentiation. In the final part of
the paper, we portray the phenomenological structure of engaged acts.

If we had to describe this novelty in the development of the ‘In-statuere’ (de)construction, we would begin from the number of acts continuously enlarged, increased by the reciprocal activity of multiple actors. A group of individuals gathers to address a problem, transparently design a solution, construct a general plan of action for providing help, and organize a series of future actions in a disciplined manner that are intended to bring about a given social change. An institution is impossible if there are no experiments or a universal solution to a general problem, one that affects everybody. There can be no institution without the organization of joint resistance, and a project of counter-institution.

‘Unjust Enemy’ or ‘Monster Dilemma’ Revisited. On the Conditions and the Paradox of a Theological Fiction

AB  - The text once more reconstructs the perennially fashionable “figure” within public and international law, as well as a theologized construction: an evil-doer who must be destroyed in the conflict or war. The “unjust enemy”, always mutually recognized and often indicated as the other side in every conflict (and particularly ambiguously and obscurely in the current war between Russia and Ukraine), should satisfy certain conditions for them to be linked to “evil” and “the alliance of all against evil”, in the production of world peace and infinite restraint from war. By classifying various forms of hostile protocols, my intention is to show the substantive incompleteness and weakness of the term “enemy”, and thus the impossibility and myth of a symmetric use of force.
AB  - U tekstu jos jedanput rekonstruišem jednu uvek u modi „figuru“ javnog i međunarodnog 
prava, ali istovremeno i teologizovanu konstrukciju zlog zločinca koga treba uništiti u suko bu ili ratu. „Nepravedni neprijatelj“, uvek međusobno prepoznat i često imenovan od obe 
strane svakog sukoba (posebno dvosmisleno i opskurno u aktuelnom ratu između Rusije i 
Ukrajine), trebao bi da zadovoljava određene uslove koji bi onda opravdali analogiju i vezu 
„zla“ i „saveza svih protiv zla“, u proizvodnji svetskog mira i beskonačnog uzdržavanja od rata. 
Namera mi je da klasifikujući različite oblike hostilitetnih protokola, pokušam da pokažem 
supstancijalnu nedovršenost i slabost termina „neprijatelj“, a onda i nemogućnost i mit o si metričnoj upotrebi sile.

AB  - My intention is to demonstrate how Hobbes’ attempts to adapt two ancient institutions from Roman
Law to his own time and knowledge of theology and philosophy. Treason (and the figure of the traitor)
could be quite significant within the context of Hobbes’ (but not only his) understanding of the figure
of the sovereign and sovereignty. The central part of the text is an endeavor to ascertain the source and
unconditional condition for treason as such, within the framework of Hobbes’ theory of representation
(representatio) which he writes about in Chapter 16 of the Leviathan. The act or performance in which we
could perhaps recognize a traitorous gesture (or the dynamic of treason) could be found in the so-called
paradox of representation. The “traitor” breaks the chain of the transfer of power and empowerment,
thus stops representation, and puts an end to speaking in the name of the other. If it is possible to discover
whether this is possible and whether speaking and acting in one’s own name always carries elements of
treason, then we can conclude that differing forms of “direct” speech and action (“in one’s own name”)
are “acts of treason.” In that case, what interests me is whether “treason” is found within the heart of representative
democracy, and thus if it is de facto an integral part of a democratic order and society.

AB  - В статье изложена версия эволюции института полиции, который исходно
являлся частью гражданского общества, а не государства. Несколько абза-
цев из лекций Гегеля по философии права становятся отправной точкой
данной реконструкции. Опираясь на высказанные в них идеи, автор объяс-
няет механизм возникновения полиции из деятельности граждан по уста-
навлению правил (протоколов) взаимодействия, надзор за которыми они
сообща ведут ради общего блага, – в этом, собственно, изначально и состо-
ит назначение полиции. Предлагаемая реконструкция может быть полезна
в двух аспектах. Во-первых, она указывает на постепенное вырождение ин-
ститута полиции, на превращение ее из института гражданского общества
в элемент системы государства и орган внешнего насилия, а следовательно,
на уменьшение участия граждан в деятельности надзора за соблюдением
общего блага и на превращение их в пассивный объект чуждого властного
воздействия. Во-вторых, данная реконструкция показывает, что различные
виды современной гражданской активности в области социальной полити-
ки (policy making) зарождались как часть первых полицейских протоколов
и связанных с ними действий.
AB  - The article presents a version of the evolution of the police institution, which
was originally part of civil society, not the state. A few paragraphs from
Hegel’s lectures on the philosophy of law become the starting point of this reconstruction.
Based on the ideas expressed in them, the author explains the
mechanism of the emergence of the police from the activities of citizens to establish
rules (protocols) of interaction, the supervision of which they jointly
conduct for the common good – this, in fact, is the purpose of the police ini -
tially. The proposed reconstruction can be useful in two aspects. Firstly, it
points to the gradual degeneration of the institution of the police, to its transformation
from an institution of civil society into an element of the state sys -
tem and an organ of external violence, and consequently, to a decrease in the
participation of citizens in the supervision of the observance of the common
good and their transformation into a passive object of alien power influence.
Secondly, this reconstruction shows that various types of modern civic activity

Hegel’s lectures on the philosophy of law become the starting point of this reconstruction.
Based on the ideas expressed in them, the author explains the
mechanism of the emergence of the police from the activities of citizens to establish
rules (protocols) of interaction, the supervision of which they jointly
conduct for the common good – this, in fact, is the purpose of the police ini -
tially. The proposed reconstruction can be useful in two aspects. Firstly, it
points to the gradual degeneration of the institution of the police, to its transformation
from an institution of civil society into an element of the state sys -
tem and an organ of external violence, and consequently, to a decrease in the
participation of citizens in the supervision of the observance of the common
good and their transformation into a passive object of alien power influence.
Secondly, this reconstruction shows that various types of modern civic activity
in the field of social policy (policy making) originated as part of the first police
protocols and related actions.",

AB  - Naš je glavni cilj opisati strukturu angažiranih akata i suosjećanja i njihovu konstitutivnu povezanost da bismo objasnili ključnu ulogu angažiranih i suosjećajnih akata za konstituiranje grupe. U prvom dijelu teksta, formuliramo ideju-vodilju: ključ za razumijevanje suosjećanja leži u razumijevanju angažmana i obratno. Zatim, okrećemo se razmatranju problematičnoga karaktera angažiranih akata: oni, s jedne strane, ne ispunjavaju uvjete pripisivosti pluralnom subjektu, dok se, s druge strane, ne mogu objasniti bez pretpostavke pluralnoga subjekta. Da bismo to razumjeli, oslanjamo se, prije svega, na Helmovu teoriju emocija i klasične fenomenološke analize konstituiranja pluralnoga subjekta, ali i ukazujemo na njihova ograničenja. U posljednjim dvama odjeljcima ćemo, nadovezujući se na Nussbauminu teoriju suosjećanja, opisati paralelizam i konstitutivnu povezanost u strukturi suosjećanja i angažmana. Na kraju, ispitat ćemo specifičan način na koji (suosjećajni) angažirani akti »stavljaju teret« i transformiraju grupu u instituciju.
AB  - Our main goal is to describe the structure of engaged acts and compassion and their constitutive
interrelation to explicate the key role of engaged and compassionate acts for group constitution.
In the first part of the paper, we formulate our guiding idea: the key to understanding compassion lies in understanding engagement and vice versa. We then consider the problematic nature
of engaged acts: On the one hand, they do not meet the conditions to be attributed to the plural
subject; on the other hand, they cannot be understood without presupposing the plural subject.
To understand this, we rely primarily on Helm’s theory of emotions and the classical phenomenological analyses of the constitution of the plural subject, but we also point out the limitations
of the latter. In the last two sections, we build on Nussbaum’s theory of compassion to describe
the parallelism in the structure of compassion and engagement and to show their constitutive
connection. Finally, we examine the specific way in which (compassionate) engaged acts “place
burden” and transform a group into an institution

The Messiness of Victory and Heroism: A Brief Response to Carl Schmitt

AB  - The article focuses on a passage from Carl Schmitt’s Ex Captivitate Salus – a book famously written in a Nurnberg prison in 1946 – in which he draws, from memory, on a story derived from Serbian epic poetry, to justify his understanding of historiography, victory, and the figure of the hero. Analyzing the entire Serbian epic poem from which Schmitt extracts the vignette in question, we show how the text of the poem presents a significantly more complicated and messy picture of the figures of victor, victory, and hero, heroism. The anonymous Serbian poet, addressing himself to his contemporary audience, with which he is intimately familiar, really subverts simplistic expectations regarding the heroism and victory of the Serbian hero, Marko Kraljević. Finally, the article contrasts these complex and at times paradoxical figures of victory and the hero in the poem with their presentation in Carl Schmitt’s writing.
AB  - U članku se dovodi u pitanje jedan pasus iz knjige Ex Captivitate Salus, Karla Šmita – knjige 
koja je, kao što je poznato, pisana u nirnberškom zatvoru u Nemačkoj, 1946. godine. U tom 
pasusu se Šmit oslanja na detalj iz srpske narodne epske pesme kako bi argumentovao svoje 
razumevanje istoriografije, pobede i figure junaka. Analizirajući celu pesmu Marko Kraljević 
i Musa Kesedžija, iz koje Šmit preuzima anegdotu o junaku Marku, u članku se ukazuje na to 
da su koncepti pobede, pobednika, junaka i junaštva u samoj pesmi znatno komplikovaniji i 
neuredniji od one koju Šmit predstavlja. Obraćajući se publici koju vrlo dobro poznaje, srpski 
pevač podriva pojednostavljena očekivanja o junaštvu i pobedi srpskog junaka, Marka Kraljevića. Članak zaključuje da je ova komplikovana slika iz same pesme daleko od pojednostavljene i manipulativne slike koju nudi Šmit.

AB  - The text reconstructs the protocol of 'victory' as part of the interruption of enmity and establishment of temporary peace. Different understandings of the enemy and enmity imply that victory in war and cessation of conflict can essentially determine the way war is conducted, and that they follow rules of war.  Victory  is  supposed  to  be  a  crucial  moment  that  characterizes  the  ethics  of  war.  Particular testimonies  and  thematizations  of  victory  in  the  Orthodox  Christian  tradition  can  provide  an  intro-duction  into  a  potential  ethics  of  war  that  could  ensure  a  new  relationship  towards  the  enemy  and killing the enemy.

AB  - We continue to publish selected chapters from the Russian version of the translation 
of the book of our permanent author, a prominent Serbian philosopher of the world scale, a 
disciple of Derrida, Petar Bojanic «Pro / Vocation. The call and the right to coup» (Bojanić
Petar. PROVOCATIO. Vokativ Ius Revolucija. Belgrade, Službeni glasnik, 2008). The book 
is written in the form of a literary-philosophical essay and is based on a series of lectures 
given by Petar Bojanic in Belgrade for the media in the second half of October 2007. The 
translation was carried out by Vojislav Stoyanovich and Victoria Bereznyak with a literary 
and philosophical edition and notes by Viktor Rimsky and Sergei Borisov. The editors keep 
the author's page-by-page references to literature and notes.
The book hermeneutically reconstructs the ancient Roman institution of provocation, 
which provided support for the defendant in the administrative court by appealing to the 
people and their justice.

AB  - U tekstu pretpostavljam da postoji pravoslavna etika rata koja ima svoje posebnosti 
i razlike naspram etike rata na Zapadu. Srpsko-ruski primeri služe da bi rekonstruisali 
neobična razumevanja neprijatelja i neprijateljstva, prekida sukoba, pobede u ratu i odnos 
pobede i mira. Ideja o specifičnom prekidu neprijateljstva i sukoba u pravoslavnom shva tanju rata treba da revidira različite protokole koji nisu dovoljno uspešni u uspostavljanju 
stabilnog i dugotrajnog mira.
AB  - The text assumes that there is a distinct Orthodox war ethics, with its particularities 
and distinctions from Western war ethics. Serbian and Russian examples serve to recon struct unusual understandings of the enemy and enmity, termination of conflict, victory 
in war, as well as the relation of victory and peace. In Orthodox Christianity, the idea of 
a specific termination of enmity and conflict ought to revise various protocols insufficiently successful in establishing stable and long-term peace.

Depois de ler Nomos da Terra de Carl Schmitt, Arendt tenta confrontar a ideia de Schmitt de uma
guerra justa. No texto, busco reconstruir as leituras de Arendt de diferentes textos de filosofia política
dentro do contexto de seu pensamento sobre a relação entre violência e poder, força e lei. A recusa
de Arendt em aceitar a existência de uma violência que pode “conquistar” a liberdade e “criar” o direito
e a democracia, contradiz a grande tradição dos seguidores de Marx, aos quais Arendt sem dúvida
pertence: A violência revolucionária é algo possível? Se sim, como? Por fim, violência como resistência
à injustiça traz justiça?
AB  - Paraphrased within the title of this text is a note Hannah Arendt made in August 1952. After
reading Carl Schmitt’s Nomos der Erde, Arendt tries to confront Schmitt’s idea of a just war. In the text
I attempt to reconstruct Arendt’s readings of differing political philosophy texts within the context of
her thinking concerning the relationship between violence and power, force and law. Arendt’s refusal
to accept the existence of violence which can “conquer” freedom and “create” right and democracy,
brings contradiction to the great tradition of the followers of Marx, to whom Arendt undoubtedly
belongs: how is and is revolutionary violence even possible and does violence as resistance to injustice
bring justice?

AB  - Lo ius provocationis, celebre istituzione della Repubblica romana, permetteva 
all’accusato (e al condannato) di proteggersi dalle rappresaglie della polizia al 
momento dell’arresto con una richiesta di aiuto al popolo (provocatio ad populum) per chiedere il riesame del processo. Lo svolgimento di una nuova udienza, davanti al popolo e con il popolo, 
rendeva possibile la modifica e il rinvio della pena (o della violenza). In questo libro Petar Bojani´c indaga e analizza lo ius provocationis, la prima organizzazio ne giuridica nella storia che proteggeva la vita e sospendeva la pena capitale. 
La ricostruzione che fa di questa istituzione dimenticata attualizza i segreti del 
termine “provocazione” e i suoi diversi usi nella storia della giustizia, della democrazia e della ribellione.

(Popper) – house, homeland, and nostalgia – in order to
show the violent strategies that determine them and on

Violence and “Counter Violence”. On Correct Rejection. A Sketch of a Possible Russian Ethics of War Considered through the Understanding of Violence in Tolstoy and in Petar II Petrović Njegoš

AB  - The article’s intention is to construct a possible minimal response to violence, 
that is, to describe what would be justified (necessary or legitimate) “противонасилие” 
(counter-violence). This argument is built on reviving several important philosophical texts in 
Russian of the first half of the twentieth century as well as on going beyond that historical 
moment. Starting with the reconstruction of Tolstoy’s criticism of any use of violence, it is then 
shown that, paradoxically, resistance to Tolstoy’s or ‘pseudo’—Tolstoy’s teachings ends up 
incorporating Tolstoy’s thematization of counter-violence into various theories, which sought 
to legitimate the use of force. In particular, Tolstoy’s discovery of a force, which, on the one 
hand, is not grounded in violence and, on the other hand, which is capable of countering 
violence, becomes fundamental in reasoning about the just use of force. The connection is made 
between Tolstoy and Petar II Petrović Njegoš, who also thematizes the use of force in Christian 
perspective. In his view, justice, “blessed by the Creator’s hand,” has the capacity to protect 
from violent force. Any living thing defends itself from what endangers it by means Creator 
bestowed it with. Living force and protective use of force are conceptually linked in Njegoš’s 
reasoning. Thus, only protective force can defeat aggressive force. This is shown to be Njegoš’s 
contribution to the Orthodox Christian discourse on violence. If a force can be counter-violent, 
the next step in our argument would be to search for a protocol that should have universal 
validity, that is, it has to be valid for all conflicting sides, The protocol of counter-violence 
requires that, firstly, it is a response to violence; secondly, it interrupts violence and forestalls 
any possible future violence (it is the ‘last’ violence); thirdly, it is subject to verification, it 
addresses those who are a priori against any response to violence (which usually refers to 
various forms of “Tolstoyism”).
AB  - Цель статьи заключается в построении возможного минимального ответа на наси лие, иными словами, в описании того, что было бы оправданным (необходимым или 
законным) «противонасилием». Этот аргумент основан на реконструкции нескольких 
важных философских текстов на русском языке первой половины ХХ века, а также на 
расширении анализа проблемы за пределы этого исторического момента. После рекон струкции критики Л. Толстым любого применения насилия показывается, что, как это ни 
парадоксально, противники учения Толстого включили разработанную Толстым идею 
противонасилия в свои теории, в которых стремились легитимизировать применение 
силы. В частности, открытие Толстым силы, которая, с одной стороны, не основана на 
насилии, а, с другой стороны, способна противостоять насилию, становится основопола гающим в рассуждениях о справедливом применении силы. Далее выстраивается связь 
между Л. Толстым и Петаром II Петровичем Ньегошем, который также тематизирует 
применение силы в христианской перспективе. По его мнению, справедливость, «благо словенная рукой Творца», способна защитить от насильственной силы. Любое живое 
существо защищается от того, что ему угрожает теми средствами, которыми его одарил 
Творец. Живая сила и защитное применение силы концептуально связываются в рассуж дениях Ньегоша. Таким образом, только защищающая сила может победить агрессивную 
силу. Это свидетельствует о вкладе Ньегоша в православный христианский дискурс 
о насилии. Если сила может быть противонасильственной, следующим шагом в нашем 
аргументе будет поиск протокола, который должен иметь универсальную силу, то есть 
он должен быть действительным для всех конфликтующих сторон. Протокол о борьбе с 
насилием требует, чтобы, во-первых, сила была ответом на насилие; во-вторых, преры вала насилие и предотвращала любое возможное насилие в будущем (это «последнее» 
насилие); в-третьих, применение силы подлежит проверке, обращено к тем, кто априори
против любой ответ на насилие (что обычно относится к различным формам «толстов ства»). Наконец, показано, что государственная власть не создает закон, а лишь правота 
создает закон, дает жизнь общественному порядку и тем самым может санкционировать 
применение силы. Это новшество в истории оправдания силы, отсутствующее на Западе. 
Агрессивному насилию может быть противопоставлена лишь та сила, которая предпола гает возможность установления закона и порядка.

(2016/2017) pelo artista e professor alemão da Universidade de Bonn, Werner Gephart, propõe-se aqui 
análise da obra “Produção babilônica de normatividade na Europa (2016)”, em diálogo com “A Torre de 
Babel”, de 1563 do artista belga Pieter Bruegel, o Velho, ambas cotejadas com os textos religiosos com 
os quais dialogam, com vistas a compreender as analogias feitas pelo autor da obra com história atual da 
Europa, sua unificação e os seus tantos dilemas mais contemporâneos.

(2016/2017) by the German artist and professor at the University of Bonn, Werner Gephart, we propose 
here an analysis of the work “Babylonian production of norms in Europe (2016) ”, In dialogue with“ The 
Tower of Babel ”, from 1563 by the Belgian artist Pieter Bruegel the Elder, both collated with the
religious texts with which they dialogue, in order to understand the analogies made by the author of the 
work with current European history , its unification and its many more contemporary dilemmas.

AB  - Inicialmente, para justificar uma leitura suplementar da Crítica da vio lência de Benjamin, eu gostaria de apresentar as formas pelas quais esse tex to foi recebido e explicar as razões por trás da rica história de suas recons truções, que vão de Scholem e Löwenthal, até Honneth, Žižek e Butler. O 
que é que produz a “força desconstrutiva” dessa colagem densa e complexa 
de textos? Não é apenas a brilhante montagem de Benjamin, mas, tam bém, parece-me, esse poderoso mal-entendido que se dissimula no título 
de meu texto: A violência divina de Benjamin e o caso de Coré. Gostaria, 
então, de completar imediatamente essa analogia entre a violência divi na e o nome de Coré com duas anotações que devem limitar e complicar 
toda interpretação suplementar: (a) diferentemente de Leo Löwenthal (1990, 
p. 174), tratarei o texto de Benjamin como uma soma de figuras e de catego rias messiânicas e, analogamente, (b) acompanharei os célebres qualificati vos que Scholem atribui ao “texto puramente judeu” de Benjamin [ein rein 
jüdischer Text], quando o caracteriza como uma manifestação de “niilismo 
positivo” ou de “nobre e positiva violência da destruição” [die edle und 
positive Gewalt der Zerstörung] (Scholem, 2007, p. 501-502). Esses dois 
elementos (o messianismo e o niilismo positivo) poderiam ampliar a minha 
intervenção sobre o texto de Benjamin e, talvez, negar a vantagem que o 
título do presente artigo goza em relação a seu subtítulo (A rebelião contra 
Moisés como o primeiro ato de messianismo). Estaria em posição de des taque, então, a sugestão ou intuição genial de Benjamin de que a primeira grande rebelião na história da justiça (e a última no quadro do mito5
 ou do 
direito) evoca ou provoca qualquer coisa de messiânico; que esse episódio 
maior na vida de certo povo – cujos iniciadores são Coré e alguns rebeldes 
– representa o começo da construção do teatro messiânico.
