Svojina – filozofska analiza : argument

AB  - Nakon kratkog istorijskog pregleda filozofskih pogleda na svojinu u tekstu se iznosi analiza argumenta kojim se svojina opravdava na osnovi univerzalnog poštovanja svačijeg prava na upotrebu stvari za bilo koju svrhu. Mogućnost upotrebe stvari za realizaciju postavljenih ciljeva je uslov mogućnosti delanja, kao stvarnog događanja u svetu. To je ono u čemu se ispoljava kapacitet slobode kao kauzalne moći u realnom svetu. Ali bez izglednosti na završetak započetog procesa realizacije cilja ta kauzalna moć bi bila praktično obesmišljena (iako bi i dalje postojala kao realna ontološka mogućnost). Svojina je shema unutar koje ova izglednost postaje aktualna, i otuda je svojina zapravo sastojak i nužna pretpostav- ka slobode kao mogućnosti svrhovitog delanja. Svojina menja normativnu pozici- ju svih drugih, oni (više) nemaju pravo slobodnog korišćenja zaposednutih stvari (onih koje su postale predmet svojine). Kao pravo svojina povlači, prvo, dužnost
poštovanja poseda koja, pored zabrane sprečavanja tuđeg korišćenja stvari u po- sedu uključuje i obavezu nesprečavanja bilo čije upotrebe i raspolaganja stvarima koje nisu već zaposednute: svačija svojina se mora poštovati, ničija svojina se mo- že slobodno zaposesti (neki oblici svojine su opšta ili kolektivna svojina). Drugo,
tek kao vlasništvo, u kome pravo raspolaganja više ne zavisi od faktičke moći ras- polaganja u posedu, svojina dobija svoj puni normativni i praktički kapacitet. Vlasništvo je garancija budućnosti prava svojine. Za ovo je potrebno eksplicitno priznanje činjenice uspostavljenosti prava raspolaganja od strane svih drugih, priznanje koje nužno sledi (ne može da se uskrati) ukoliko niko nije povređen ovim raspolaganjem. To sledi iz prirode razlike između stvari i osoba, koje su ličnosti sa kapacitetom za slobodno delanje (korišćenje sredstava za realizaciju postavljenih
ciljeva). Po svojoj prirodi stvari se mogu posedovati, a kako je upotreba sredstava za bilo koji legitimni cilj takođe legitimna to svaka neposedovana stvar može bez prepreka postati predmet svojine, bilo zaposedanjem bilo transferom.

Drugo,
tek kao vlasništvo, u kome pravo raspolaganja više ne zavisi od faktičke moći ras- polaganja u posedu, svojina dobija svoj puni normativni i praktički kapacitet. Vlasništvo je garancija budućnosti prava svojine. AB  - Moglo bi se reći da je prosvetiteljstvo (prosvećenost), već od svojih modernih početaka pa sve do savremenih rasprava o njegovom značaju, u hroničnoj nedoumici oko vlastitog odreĎenja i razumevanja. Namera ovog rada je da, pre svega, rasvetli
podležeće i produktivne aspekte upotrebe tog naizgled samorazumljivog, a često do nerazabirljivosti višesmislenog pojma. To će se postići detekcijom smeštanja, izmeštanja i premeštanja težišta njegovog značenja i dejstva kod različitih autora koji su ga tematizovali od osamnaestog veka do danas. Kantova definicija prosvećenosti iz njegovog članka „Odgovor na pitanje: šta je prosvećenost?“ poslužiće pritom kao osnovni talon na kojem će se iskušavati vizije prosvetiteljstva. Čini se da se ona pokazala onom nezaobilaznom instancom s obzorom na koju se – priznanjem njene neprolazne merodavnosti, preadaptacijom ili osporavanjem – i dalje artikulišu ili makar
prikladno prireĎuju i od nje drugačije koncepcije  prosvetiteljstva...

AB  - Neuroetika je najnovija i verovatno najbrze rastuca grana bioetike i, mozda, primenjene etike uopste. U njoj se polazi od teze da odredeni pri- rodni procesi u mozgu i nervima proizvode odredena moralna i nemoralna ponasanja (a nisu samo prirodna osnova takvih dogadanja). Kao prirodni procesi ovi dogadaji se onda mogu do kraja i bez ostatka uzrocno objasniti. U tom smislu neuroetika bi trebalo daje zavrsnica i vrhunac neuronauke (neurologije i drugih njoj bliskih nauka), koja u nase vreme zaista dozivljava ogroman napredak. U tekstu se ukazuje na izvesne metafizicke i eticke tesko- ce ovog pristupa, pre svega u preklapanju pojmova (uzrocnog) objasnjenja i (razloznog) opravdanja u nacinu definisanja vrednosti, ne samo moralnih. Sasvim je sigurno da je funkcionisanje nervnog sistema vazan parametar u opisu i objasnjenju pre svega oseta i osecanja, a onda i svega ostalog sto se na vrednosnom planu gradi na toj osnovi. Znanje o procesima sa kojima se tu srecemo sigurno moze pomoci ne samo da se otklone razni problemi koji ugrozavaju kvalitet ljudskog zivota nego se moze iskoristiti i za poboljsanje tog kvaliteta tamo gde on nije direktno ugrozen. U tom smislu neuroetika spada u etiku sredstava (kako koncipirati, proizvesti, distribuisati i upotrebiti to znanje). Ali pretenzija neuroetike ide dalje od ove instrumentalne upotrebe znanja do kojih dolazi neuronauka i proteze se na artikulaciju ciljeva i na pretpostavku da se ta artikulacija moze upotpunosti uzrocno objasniti. Glavni fokus rada upravoje analiza ove pretenzije, kroz analizu razlika izmedu uzro- ka i razloga, objasnjenja i opravdanja, sredstava i ciljeva. Na kraju, u odeljku oprimenama, daje se sumarni pregled koristi i rizika koje neuroetika donosi, sa zakljuckom da ona sigurno moze znacajno pomoci da se kvalitet ukupnog zivota, individualnog i socijalnog, unapredi.

Pacifism : Still the Issue

AB  - The 12th ILECS conference (International Law and Ethics 
Conference Series) is devoted to the issue of Pacifism,once
much more popular theme than today. In times when we 
rethink the issue of the war, from its criminalization through 
its instrumentalization in humanitarian interventions to its 
usage in “asymmetric” and anti-terrorist warfare and its role 
in the attempt to legalize torture, pacifism might seem to be 
quite obsolete and redundant. Could it mean that pacifism is 
not an issue anymore? Or, as we found in the theme of world 
governance in one of the previous ILECS conferences, it is one 
of those issues which are always with us, looming from the mist 
of unstable reality, as a promise, or false promise, or as a refuge 
or escape? Or could it be a long awaited, even a final, solution 
guarding us from pitfalls and predicaments of our uncertain 
and non-transparent future full of threatening conflicts? We do 
not expect all these questions to be answered, but perhaps it is 
proper time to raise them again.

AB  - Before I explain this complicated title, especially the quotation marks around the word “Pirates,” and before I reveal my intention and attempt to provisionally justify it (in the title I discretely introduce and transform Fichte's Closed Commercial State into a great world state or empire, always open and borderless; I assume that a world as such cannot be closed), I will first cite a part of the 54th paragraph from Kant's 1797 work The Metaphysics of Morals. My intention is not to simply evoke Carl Schmitt's critique of Kant's ideas concerning preemptive war and the unjust enemy—as we all know, these ideas were not Kant's nor is their critique original (Schmitt, 2006:168–171) after all, both Kant and Schmitt are simply brilliant compilers in international law—rather, I want to preliminarily demonstrate that every project concerning the constitution of an empire, league of nations or world government (or world governance) implies a paradoxical existence of an ambiguous “exterior” (“outside,” “without”). It seems that the existence (or nonexistence) of something “outside” of the world or “outside” of borderless sovereignty, is a precondition for any theory of world governance.

In the chapter which deals with public right (the Right of Nations), Kant presents four basic elements of natural rights. We are interested in the third element:

A league of nations in accordance with the idea of an original social contract is necessary, not in order to meddle in one another's internal dissensions but to protect against attacks from without (Kant, 1996:482ndash;483).

Two editors of Kant's works believed that Kant did not provide an object to which this sentence is referring. Vorländer believed that “enemies” (outside enemies) [gegen Angriffe der äuβeren Feinde zu schützen] should be added, while Natorp thought that “nations,” were in question, meaning that attacks come from other nations/people. I find the existence of any “outside”/“without”, any sort of space for an enemy or nation (for a terrorist, pirate or alien) problematic because a union of nations, as well as an empire, surely assumes that all nations are already inside and together. Why does a project concerning the union of all nations presume the existence of another space? How is it possible that something else exists, another entity or figure, that does not take part in finalizing this new community and new unity? Does every fusion and union presuppose omission and exclusion?

AB  - In this age of the overarching globalization and increased public sensitivity, conflict resolution is becoming more and more demanding both in terms of its goals and its techniques. The war has become almost forbidden, and old schemes of justifying wars no longer appear satisfying. Justifying war always seemed to be a hopeless task: at the same time impossible and necessary. Being tragic and often also absurd throughout the history, war is now facing the challenge of a change its very definition. Its nature of unpredictability and irreversibility, its constitutive rules of victory and defeat, seem to be in the process of an extensive change, with new aspects and issues emerging: criminalization of war, new ways of justifying military interventions, and a huge set of instruments of justifying “asymmetric wars”, “wars on terror”, pre-emptive and preventive wars, peace-making and peace-keeping activities, regime change strategies, etc. Just War Theory and its justificatory capacity is (again) at the crossroad: is it a new chance to further its development, or a sign of its end? These and other issues regarding contemporary debate about the war are worth further exploration from the philosophical point of view.

Non-culpable ignorance and just war theory

AB  - The so called “non-culpable ignorance” is an instrument to justify participating in a war on a defeated side, on condition that fighters sincerely believe that they are defending a just cause and had some valid reasons to believe in having a
chance to win. Within the just war theory this instrument is needed to make both sides prima facie right, otherwise the theory would imply that those who lose are guilty in advance, especially if they are the weaker side. However, in contemporary context of criminalizing war the very concept of war is changing and becoming extremely vague.
As wars are more and more “asymmetric”, just war theory might face serious challenges regarding incorporation of “non-culpable ignorance” within its scope, as well as difficulties in showing that justice goes with the victory, opening thus the issues of articulation of a just peace.
